تلعب الاستثمارات دوراً مهماً في عملية التنمية الاقتصادية والاجتماعية في أي مجتمع، متقدم أو نام أو أقل نمواً، حيث لم يعد بالإمكان اليوم لأي دولة تحاول الارتقاء بمسيرة التنمية عن طريق الاستثمارات أن تتصور نفسها دون إطار قانوني معين لجماية الاستثمارات فيها، فوجود تلك القوانين ينطوي عليه جذب الاستثمارات الأجنبية وحفزها، وبخاصة في ظل التطورات الاقتصادية والتكنولوجية التي تجتاح العالم، وكذلك في ظل اقتصاد عالمي يتجه نحو اقتصاد السوق. وبهذا أضحى وجود أنظمة حمائية للاستثمارات أمراً ضرورياً، إذ في حال انتفائها ستكون الدولة أقل جاذبية للاستثمار.
وتعد وثيقة تسوية نزاعات الاستثمار، الصادرة بموجب "اتفاقية المركز الدولي لتسوية نزاعات الاستثمار"، أبرز ما يمكن بحثه في هذا المجال، بوصفها أهم الضمانات الإجرائية للاستثمار، فهي تمنح المستثمر ضمانة حيال عدم عرض أي نزاع محتمل بينه وبين الدولة المضيفة لاستثماره على القضاء الوطني، وإنما على المركز الدولي لتسوية نزاعات الاستثمار في واشنطن.
وتنبع أهمية هذه الدراسة مما شهدته السنوات الأخيرة من إدراك لخطورة نزاعات الاستثمار، وتأثيرها على النظام الاقتصادي المعاصر والتجارة الدولية، من هنا سعت معظم الدول إلى إدراج ضمانات الاستثمار وحوافزه ضمن سياساتها الوطنية، نظراً إلى أن تلك الضمانات والحوافز باتت أداة رئيسية في تنمية المجتمعات، كما تم سن التشريعات التي تكفل حقوق المستثمرين وتصونها من الضياع أو الانتهاك، ورافق ذلك اهتمام دولي تمثل في إيجاد العديد من الاتفاقيات الدولية والمعاهدات التي تنظم موضوع الاستثمار وآليات فض نزاعاته في إطار دولي محكم يضمن حماية فعالة لحقوق أطراف العلاقة الاستثمارية. من هنا برزت أهمية دراسة الإطار الدولي لتسوية نزاعات الاستثمار، انطلاقاً من مقاربة ترتكز على أن الاستثمار أداة للتنمية. ومن ثم، فإن أي معوقات تقف أمامه ستلحق الضرر حتماً بجهود التنمية.
وتهدف هذه الدراسة إلى مناقشة أهمية الاستثمارات انطلاقاً من علاقات التأثير والتأثر بينها وبين التنمية. وتقوم بعرض الأحكام العامة لاتفاقية تسوية نزاعات الاستثمار، وتحليلها مع محاولة استعراض نطاق أعمالها، ثم عرض أمثلة تطبيقية لشرح نطاق تطبيق هذه الاتفاقية. وتحاول توضيح مجموعة من المسائل مثل علاقة الاستثمار بالتنمية، ومدى حاجة الاستثمار إلى ضمانة إجرائية تتمثل في وسائل تسوية النزاعات الاستثمارية، وهيكلية الإطار الدولي لتسوية نزاعات الاستثمار وماهيته، وآليات تسوية نزاعات الاستثمار بحسب اتفاقية المركز الدولي لتسوية نزاعات الاستثمار.
