إن موضوع الفحص الطبي قبل الزواج موضوع حديث ومهم، له أبعاده الشرعية والطبية، والقانونية، فهو من مجالات التغيير نحو الأفضل في مجتمعاتنا الإسلامية، إنطلاقاً من أن الشريعة الإسلامية تقوم على كليات تراها الأساس الأول لقيام الحياة الكريمة التي من أجلها تم الحث على حماية تلك الكليات التي من أهمها حفظ النفس، وحفظ النسل.
ومن هنا كانت الدراسة، وكان عنوانها: الفحوصات الطبية قبل إبرام عقد الزواج أسانيدها ومقاصدها "دراسة مقارنة"، وهذا العنوان كان بناء على تصميم بنية منهجية، تتسم بالتسلسل المنطقي في عرض الأفكار، والإنتقال بها وطرحها بما يخدم أهداف الدراسة، وغاياتها، وتحقيق ذلك تطلب تقسيم الدراسة إلى فصلين: يسبقهما تمهيد وفقاً للبنية المنهجية الآتية: الفصل الأول: للأسانيد الشرعية للفحوصات الطبية قبل الزواج، والذي قسم إلى مبحثين: الأول: للمصادر النقلية، الثاني: للمصادر العقلية، أما الفصل الثاني: لمقاصد الفحوصات الطبية قبل الزواج، والذي قسم هو الآخر إلى مبحثين: الأول: لحماية مصالح أطراف العلاقة، الثاني: لحماية مصالح المجتمع.
وربما الذي جعل الباحثة تتبني هذا التقسيم، أن العنوان أملى ذلك، وأن هذا الإملاء كان منسجماً مع طبيعة الدراسة، ومحاكياً لتسلسل أفكارها، وهذا يعد دافعاً آخر لتبني ذلك التقسيم.
