إن الدولة تلجأ إلى أسلوب التعاقد الإداري لغرض تسيير مرافقها العامة بالشكل الذي يؤدي إلى تحقيق المنفعة العامة.
فالمهتم بشأن العقود الحكومية وعند ملاحظته للتعليمات الخاصة بها وفي كافة الدول، يلاحظ أن الدولة تضع أكثر من أسلوب تعاقدي وبعدة إشكال وهنالك قواعد عامة لكل الأساليب وقواعد خاصة لكل أسلوب، فالغرض من ذلك إعطاء حرية للإدارة بإختيار الأسلوب الأمثل الذي من خلاله تستطيع إشباع حاجة المجتمع بصورة مثلى وفقاً للقواعد الخاصة بهذا الأسلوب.
لذلك استعرضنا في بحثنا هذا عملية التعاقد الحكومي وفقاً لدراسة مقارنة تسليط الضوء على المراحل التي ينبغي على الإدارة مراعاتها وصولاً إلى مرحلة توقيع العقد مع إسناد هذه المراحل بالآراء الفقهية والقرارات القضائية وموقفها الإيجابي أو السلبي من الإجراء الإداري المتخذ.
فالإدارة عليها إتباع الإجراءات الإدارية التعاقدية المنصوص عليها في القانون والتعليمات وبذات الوقت عليها تطوير هذه الأساليب وبشكل مستمر وفقاً للحركة التعاقدية في العالم كون الدولة لا تستطيع أن تعزل نفسها عن العالم الخارجي، وخاصة في الوقت الحاضر ظهر الكثير من المصطلحات التي لها تأثير على التعاقد الإداري ومنها العولمة، عقود المشاركة بين القطاع العام والقطاع الخاص في سبيل تحقيق الهدف الرئيسي وهو تحقيق المنفعة العامة للمجتمع.
