إن حقوق المريض هي أحد الآثار المترتبة على عقد العلاج الطبي الذي يعد من العقود الهامة التي تبرم يومياً في المجتمع، وقد يتعرض المريض لإنتهاكات عديدة لحقوقه التي تثبت له بموجب هذا العقد دون أن يدرك ذلك، حيث لا توجد لائحة خاصة تنظم تلك الحقوق في أغلب البلدان العربية، بالإضافة إلى كون عقد العلاج الطبي عقداً غير مسمى في أغلب القوانين المدنية ولم تنظم أحكامه على الرغم من خصوصية هذا العقد.
ومن هنا كانت الدراسة لإبراز أهم حقوق المريض في هذا العقد، كحقه في إختيار الطبيب الذي سيتعالج عنده وحقه في تلقي العناية اللازمة في جميع مراحل العلاج وحقه في تبصيره بحالته وبالعلاج المقترح له ومخاطره وحقه في إبداء الرضا عن العلاج المقترح له، وكذلك حقه في إنهاء العقد وفي حفظ أسراره حتى بعد إنتهاء العقد.
فالكتاب يبحث في طبيعة عقد العلاج الطبي وتحليل الآراء الفقهية التي طرحت بهذا الصدد وكذلك دراسة وتحليل حقوق المريض في ضوء ما وردت من أحكام عامة في القانون المدني والأحكام الخاصة الواردة في القوانين والأنظمة والتعليمات الصحية ومقارنتها في مختلف البلاد العربية وبعض الدول الغربية.
