Book Description
يقصد بكلمة "القانون" في اللغة العربية مجموعة القواعد الملزمة التي تنظم علاقة الفرد ببقية الأفراد وبالدولة وعلاقة الدولة ببقية الدول. والقانون بهذا المعنى يسمى بالفرنسية Droit التي تعني في اللغة أصلاً "الحق"، فيقال كلية الحقوق،أو القانون ويقال: علم القانون وشرح القانون ودراسة القانون وأصول أو مبادئ القانون أو المدخل للقانون، ويقال تأريخ القانون ومصادر القانون... إلخ. ولو أضفنا كلمة أو كلمتين إلى كلمة "القانون"، لضاق معناها ولم تعد تعبر إلا عن قسم أو فرع معين من أقسامه أو فروعه، أي عن طائفة معينة من القواعد المنظمة الملزمة المتضمنة الحقوق والواجبات، فيقال: القانون الخاص، والقانون المدني، والقانون التجاري، والقانون الدولي الخاص، والقانون الدولي العام... إلخ. أو لا تعود تعبر إلا عن مجموعة القواعد الملزمة في بلد معين أو مجموعة معينة من البلدان، فيقال: القانون الأردني، والقانون العراقي، والقانون الفرنسي، والقانون الإيطالي، ويقال القانون الروماني، والقانون العثماني... إلخ، كما يقال: القانون المدني السوري، والقانون التجاري المصري، والقانون الدستوري السويسري، والقانون الإداري الإسباني... إلخ. فالقانون، بهذا المعنى، يشمل القواعد الملزمة كافة، مكتوبة كانت أم عرفية (غير مكتوبة)، بعكس القانون بمعناه الثاني الذي يقال له بالفرنسية Loi، أي مجموعة القواعد الملزمة المكتوبة التي تصدرها السلطة المختصة لتنظيم علاقة معينة أو مجموعة علاقات معينة، فهو بهذا يعني التشريع أو التقنين (Code, Legislation بالفرنسية و Act بالإنجليزية)، فيقال: القانون المدني رقم (43) لسنة 1976 وقانون التجارة رقم (12) لسنة 1966 وقانون الشركات رقم (22) لسنة 1997 وقانون التجارة البحرية رقم (12) لسنة 1972... إلخ.
