مما لا شك فيه أن إختراع الطائرة مثل أحدى الإنجازات المهمة في حياة البشرية، إذ أصبحت تعد أحدى أهم وسائط النقل، وذلك بسبب سرعتها الفائقة وقدرتها على قطع المسافات البعيدة في ساعات قليلة، ثم تعددت الوظائف التي تقوم بها إذ لم تعد قاصرة على إستخدامها في أغراض نقل الأشخاص أو البضائع أو الأغراض العسكرية، وإنما أصبحت تستخدم في الأغراض العلمية والزراعية والصحية.
ومنذ ظهور الطائرة والشروع في الرحلات الجوية الأولى فقد أدرك المشرع الوطني والمجتمع الدولي المخاطر الناشئة عن إستعمالها، والأضرار التي تتولد عنها، لذا اتجهت الجهود إلى وضع القواعد القانونية التي تحكم الملاحة الجوية والأنشطة التي تقوم بها الطائرة، وأسفر ذلك عن صدور العديد من القوانين الوطنية ووضع العديد من الإتفاقيات أو المعاهدات الدولية التي نظمت الملاحة الجوية ومختلف الأنشطة التي تقوم بها الطائرة، وهذا ما أسهم في ظهور فرع جديد من فروع القانون أطلق عليه بالقانون الجوي أو قانون الطيران.
ويمثل هذا المؤلف شرحاً لبعض المبادئ والأحكام الأساسية التي تحكم الملاحة الجوية والنقل الجوي الدولي في ضوء إتفاقيتيي وارشو لعام 1929 ومونتريال لعام 1999، ومسؤولية الناقل الجوي الدولي وفقاً لهاتين الإتفاقيتين.
