إن عملية التقاضي هي عبارة عن قمه هرمية متدرجة، ومركبة من مجموعة إجراءات، يحتم على المتخاصمين أن يراعوا هذه الإجراءات، والترتيب الزمني فيها بدءاً من كتابة إستحضار "الدعوى" إلى صدور حكم فيها، وكل إجراء سيتغرق وقت طويل لإنجازه في ظل النظام القضائي العادي.
إنطلاقاً من هذه المضمون جاءت دراسة مؤلفنا لتسلط الضوء على معالجة مشكلات بيئة التقاضي العادية، بإعتماد نظام معلوماتي يرتكز عل تكنولوجيا المعلومات، أي "بيئة تقاضي إلكتروني"، فقد أثرة هذه الأخيرة في الدعوى فحولتها "دعوى إلكترونية" تتكون من رموز مشفرة ترسل وتستقبل بواسطة البريد الإلكتروني، وكذلك الحال في المحاكمة، في ظل هذه التكنولوجيا أصبحت تتعقد بين الخصوم عن بعد، تحت إشراف المحكمة التي تدير الجلسة عن بعد، وبعد أن تكتمل عملية التقاضي بهذه الطريقة يصدر فيها حكماً قضائياً إلكترونياً، حيث يكون هذا الأخير على ثلاث أنواع بريدياً، وممغنطاً ونموذجياً ويتاح على موقع المحكمة في الجزء المخصص لذلك، وبإمكان الخصوم والجمهور الإستفادة من هذا الحكم.
وكذلك الحال إذا لم يقتنع الخصوم في الحكم القضائي فابمكانهم الطعن فيه وبالطريقة المعلوماتية حيث يرسل الحكم لموقع المحكمة، وبعد أن يسجل يحال للجهة المختصة بنظر الطعون وتتم هذه العملية صورة سريعة ومختصرة.
لذلك إجراء عملية التقاضي بالإعتماد على الوسائل الحديثة تقلل من الشكلية في إجراءات التقاضي، وتوفر للخصوم الوقت الكافي والمختصر للحصول على حقوقهم.
