مع التوجه الذي تشهده دول العالم للإنتقال إلى الحكومات الإلكترونية، ومع إنتشار التعامل بالتقنية المعلوماتية لمميزاتها غير المحدودة كوسيلة تواصل بين الأفراد ليس في قضاء معاملاتهم الرسمية وفي التواصل مع بعضهم البعض تظهر الحاجة ملحة في الحياة المعاصرة إلى الإلتفات للجرائم التي يمكن أن تمس هذه الكيانات خلال تعاملها بالتقنية المعلوماتية، والتي تواجه إشكالاً صريحاً بعدم إمكانية معالجة معظم هذه الإنتهاكات المخالفة للقانون بالأحكام المعمول بها في قانون العقوبات والقوانين المكملة له بإعتبارها نصوصاً تعالج الظروف الطبيعة التي تتحقق فيها أركان الجريمة، وذلك على خلاف الجريمة المعلوماتية التي لا تكون مرئية عادة ولا تكتشف في معظم الأحيان إلا بمحض الصدفة، فكيف يمكننا حماية سرية البيانات والمعلومات على أجهزتنا المعلوماتية إذا لم يبادر المجرم المعلوماتي بإساءة إستغلالها، كما تقع في الوسائط المعلوماتي العديد من الجرائم التي تهدد المجتمعات العربية أو التي تهدد الأمن الداخلي أو الخارجي للدولة مثل التحريض في الجرائم الإرهابية والإتجار بالبشر والترويج للمواد المخدرة، الأمر الذي يتطلب الوقوف على حيثيات كل حالة وعلى الأوجه المتصور وقوع الجريمة به في الوسط المعلوماتي وبإستخدام التقنية المعلوماتية وآلية الكشف عنها والتحري والإستدلال، كما تعرضت هذه الدراسة إلى كيفية الموازنة بين حدود الإباحة في التعاطي مع هذه التقنية والمساحة التي تخرج بعدها عن إطار المشروعية.
