لما كان الدور الأساسي الموكل إلى القاضي الدستوري هو الرقابة على إحترام الدستور من السلطة التشريعية بالدرجة الأولى، ولما كان مبدأ فصل السلطات يتضمن ضرورة التعاون والرقابة المتبادلة بين السلطات التشريعية والتنفيذية والقضائية، فإن عدم رقابة القضاء على قوانين السلطة التشريعية قد يؤدي إلى إستبدال البرلمان وخرقة لمبادئ الدستور دون قيودٍ أو جزاء.
لذلك تحرص النظم الدستورية الحديثة على رقابة العمل التشريعي صوناً لأحكام الدستور.
مع هيمنة السلطة التنفيذية على عملية التشريع في البرلمان، تلاشى الفصل بين السلطتين التشريعية والتنفيذية، حيث أصبحت هذه الأخيرة هي المدير الفعلي للعمل التشريعي.
كذلك فإن السلطة التنفيذية تستقل بإصدار العديد من التشريعات الفرعية.
والحال، إن إتساع صلاحيات السلطة التنفيذية يضاعف من مخاطر مخالفتها لأحكام الدستور، مما يثور معه تساؤل مركزي حول الجهة المنوط بها إجبار السلطة التنفيذية على إحترام أحكام الدستور وعدم مخالفتها.
ولما كانت الأنظمة الدستورية المختلفة قد أسندت الإختصاص بالرقابة على دستورية القوانين إلى القضاء الدستوري، لكنها اعتمدت حلولاً متباينة في مسألة الرقابة على دستورية التشريعات الحكومية، كان هذا الكتاب محاولة للإضاءة على هذا الموضوع الهام من مواضيع القانون الدستوري.
