كتاب يتناول بالبحث والدراسة نظام الحكم في عهد الرسول صلى الله عليه وسلم الذي استمد منه نظام الخلافة شرعيته ، فبين أهم صفات هذا الحكم ومواصفاته ومعالمه .وجوانب الشبه بينه وبين نظام الخلافة ...الخ
وقد اقتضى ذلك من المؤلف أن يخصص ستة فصول لمعالجة مفردات الكتاب في إطار شمولي ينطلق من نظرية الدولة كما هي معروفة في القانون الدستوري ومواءمة مباحثها مع معطيات التاريخ الإسلامي في عصر الرسالة والفقه السياسي الإسلامي.
وهكذا، فقد عالج المؤلف في الفصل الأول ظهور الإسلام في مكة ونشأة الدولة الإسلامية في المدينة، وعرض في الفصل الثاني فكرة السيادة والسلطة في الدولة الإسلامية، أما الفصل الثالث فقد خصصه لدراسة السلطات الثلاث في هذه الدولة، وهي السلطة التشريعية والتنفيذية والقضائية وبحث المؤلف في الفصل الرابع العلاقة بين السلطات في الدولة الإسلامية في ضوء نظريات تركيز السلطات وفصلها في القانون الدستوري، أما الفصل الخامس فقد خصص لدراسة حقوق المساواة والحرية كما عرفتها دولة الإسلام في عهد الرسول (صلى الله عليه وسلم)، وقد تولى الفصل الأخير عرض الملامح العامة لطبيعة حكومة الرسول (صلى الله عليه وسلم).
