يعدُّ كتاب "تاريخ قضاة الأندلس" أو "المرقبة العليا فيمن يستحق القضاء والفتيا"، لأبي الحسن، عليّ بن عبد الله بن محمَّد بن محمَّد بن الحسن الجُذاميّ، المالقيّ، النباهيّ، المتوفى في أواخر القرن الثامن الهجري، من أنفس تلك المصنفات وأهمها، كونه صُنّف في وقت متأخِر عن سابقيه، الأمر الذي مكن مؤلفه من الإحاطة بمدة طويلة من الزمن، امتدت من الفتح العربي للأندلس، إلى أواخر القرن الثامن للهجرة.
وبالرغم من أهمية هذا الكتاب في التأريخ للقضاء الأندلسي وأعلامه، على إمتداد ثمانية قرون، إلاّ أنه بقي مجهولاً للناس، ولم يفطن إليه الكثير من أصحاب كتب التراجم والادب، حتى وُفِّق إ. ليفي بروفنسال، أستاذ اللغة والحضارة العربية في جامعة "السوربون"، ومدير معهد الدراسات الإسلامية بباريس في العثور على نسختين للكتاب في المغرب، بعنوان "المرقبة العليا فيمن يستحق القضاء والفتيا"، وجد النسخة الأولى في المكتبة الشريفية بالرباط، وعثر على النسخة الثانية في مكتبة جامع القرويين بفاس.
