ينشر هذا السفر أثراً لم يطبع إلى اليوم، وهو وثيقة عظيمة الخطر عن تاريخ القضاء بالغرب الإسلامي في العصر الوسيط، فتاريخ تصنيفه المتأخر مكن مؤلفه من الإحاطة بمدة طويلة من الزمن، تمتد من الفتح العربي إلى القرن الثامن الهجري، غير أن هذا الكتاب، رغم اتساع الموضوع الذي تناوله، بقي مجهولاً إلى يومنا هذا. ولا يوجد عنوانه، في إحدى المؤلفات التي أحصت الكتب المتعلقة بالأ النيل والفرات:
ينشر هذا السفر أثراً لم يطبع إلى اليوم، وهو وثيقة عظيمة الخطر عن تاريخ القضاء بالغرب الإسلامي في العصر الوسيط، فتاريخ تصنيفه المتأخر مكن مؤلفه من الإحاطة بمدة طويلة من الزمن، تمتد من الفتح العربي إلى القرن الثامن الهجري، غير أن هذا الكتاب، رغم اتساع الموضوع الذي تناوله، بقي مجهولاً إلى يومنا هذا. ولا يوجد عنوانه، في إحدى المؤلفات التي أحصت الكتب المتعلقة بالأدب العربي: فلم يذكره حاجي خليفة، ولا بروكلمان. وعبثاً يبحث المرء عن أثر له في مكاتب أوربا والشرق اليت نشرت فهارسها، وسبب ذلك، ولا شك، أن الناس لم يتناقلوا منه نسخاً. وقد جلب عدد قليل منها، في آخر القرون الوسطى، من مملكة غرناطة الصغيرة إلى مدن المغرب الأقصى. وهناك ساعدني الحظ، فاكتشفت منه نسختين خطيتين.
والنسخة الأولى محفوظة بالمكتبة الشريفية بالرباط وهي نسخة قريبة العهد، غير مؤرخة، وهي مذيلة بتلخيص من خط الناسخ نفسه، يشتمل على 13 ورقة، مؤرخ بتأريخ 20 صفر 1221. فهذا المخطوط الموجود بالرباط هو الذي اتخذ أصلاً اعتمد عليه في إثبات النص. أما المخطوط الآخر، المحفوظ بمكتبة جامع القرويين بفاس فهو نسخة تأريخها أقدم، ولكن ينقصها، الثلث الأخير تقريباً، وهي تحوى 50 ورقة ضيقة الخط، خطها من النوع المغربي، وكلتا النسختين تذكر عنوان الكتابن وهو "كتاب المرقبة العليا، فيمن يستحق (كذا، عوضاً عن "استحق" القضاء والفتيا، وكذلك اسم المؤلف وهو: أبو الحسن النباهي.
