وللإجابة على هذا السؤال ، بدأ المؤلف بتمهيد عن حد الوقف ، وتاريخه ومشروعيته وأقسامه وأركانه ، وأتبع ذلك بثلاثة فصول ، تناول في الفصل الأول منها : غير المسلمين في الفقه الإسلامي والقانون ؛ وهم : أهل الذمة والمستأمنين والمعاهدين والمحاربين ، بينما بحث في الفصل الثاني : أوقاف غير المسلمين ؛ حيث تحدث عن طبيعة الوقف ، وبحث في حكم الوقف من غير المسلمين ، وتابع في الفصل الثالث حول الإستعانة بغير المسلمين في الأوقاف الإسلامية ، وإثبات الأوقاف الإسلامية ، والدفاع عنها ..
