لقد تَجلّى للباحثِ من خلالِ هذهِ الدراسة أنَّ حماية حقوق الإنسان وحرّيّاته الأساسيّة أصبحتا تُشكّلان اليوم أحد الموضوعاتِ المُهمّةِ والرئيسة، سواء على المستوى العالميّ، أم على المستوى الإقليميّ، فضلاً عن المستوى الوطنيّ الإفرادي للدًّول؛ بحيث صارَ مبدأ إحترام حقوق الإنسان أحد المعايير المُهمّة في تحديدِ العلاقات والمعاملات الدوليّة، وكذلك في قياسِ التطوّر السياسيّ والإقتصاديّ والإجتماعيّ لأيّ مُجتمع.
تجدر الإشارة إلى أنَّ إنشاء مُنظّمة الأُمم المتّحدة عام (1945) شَهِدَ طفرةً هائلةً وغير مسبوقة في الإهتمام بقضايا حقوق الإنسان؛ إذ أخذ العالم يتحوّل وبشكلٍ تدريجيّ من النظرة التقليديّة إلى هذه الحقوق، والتي قامت على إعتبارها من قِبل المسائل التي تندرج ضمنَ الإختصاص الداخلي للدُّول، إلى إعتبارها مساحةً وسطى بين إهتمامات كُلٍّ من المُجتمع الوطنيّ والمُجتمع الدوليّ في آنٍ واحدٍ.
ويوماً بعد يوم تزداد جُهود المجموعة الدوليّة في النضالِ والكفاحِ لأجلِ إصدارِ الإعلانات واللوائح التي تحمي الحقوق والحرّيات العامّة للإنسان، وقد بدأت مُنظمة الأُمم المُتِّحدة تتنبّه إلى ضرورة وجود جهاتٍ تنظُر في الإنتهاكات الحاصلة والمُخالفة لإعلاناتها.
أمام ذلكَ التطوّر، عرف مجال حقوق الإنسان تطوّراً نوعيّاً على المستوى الإقليميّ، فقد تمَّ إبرام إتفاقيّات إقليميّة على المستوى الأوروبيّ، والأمريكي، ثم الإفريقي، والعربي، والملاحظ هو أنَّ هناك تفاوتاً في درجة توفير الحماية حتى على المستوى الإقليميّ.
والمُلاحظ في هذا الشأن، تلكَ العلاقةُ بينَ تطوّر الأنظمة السّياسيّة من حيث تطبيقها للديمقراطيّة، وقبولها بوجود آليّات حماية دوليّة لحقوق الإنسان، فكلّما كانت الدولة تُطبِّق الديمقراطيّة، ويخضع نظامها للقانون، فإنَّ ذلكَ لا يمنع من قبولها الخُضوع لآليّات حماية دوليّة لحقوق الإنسان، لأنها تُشارك هي بنفسها في مُنطلق مُمارستها لسيادتها بوضّع تلك الآليّات، ولا تُمانع في أن يُقاضيها مواطنوها أمام محاكم حقوق الإنسان.
