يُعد حق الإضراب من أهم الحقوق الإقتصادية والإجتماعية التي اعترفت بها الإتفاقيات والمعاهدات الدولية، كما يُعد هذا الحق من أقدم وأهم وسائل تنظيم حل منازعات العمل الجماعية، ولم تقتصر أهمية الحق على الإتفاقيات المذكورة فحسب بل تعداه الأمر إلى الدساتير والقوانين الداخلية، إذ نلاحظ أن هناك شبه إجماع في تضمين قوانين العمل في الدول محل المقارنة وهي كلا من فرنسا ومصر ولبنان والعراق نصوصاً تحدد القواعد العامة والتفصيلية التي من شأنها تنظيم ممارسة هذا الحق، إلا أنها لم تتفق فيما بينها بشأن القيود المفروضة على حق العامل في الإضراب يستوي في ذلك بالنسبة للعاملين في القطاع الخاص أو العام، إذ نجد إن هذه القيود المتعلقة بممارسة حق الإضراب في القطاع العام أوسع من تلك القيود الموجودة في بالقطاع الخاص.
لذا، فقد جاء هذا الكتاب ليبين كافة المسائل المتعلقة بممارسة العامل لحقه في الإضراب من حيث التعريف بالإضراب وبيان عناصره وأنواعه، وتمييزه من الأنواع الأخرى من صور التوقف عن العمل كالإستقالة والغلق (إغلاق المنشأة)، كما يعالج هذا الكتاب كافة القيود المفروضة على ممارسة حق الإضراب يستوي في ذلك القيود الإتفاقية أو الشكلية أو المتعلقة بتصرفات العمال المضربين، فضلاً عن تبيان أثر الإضراب على عقد العمل من حيث مدى إعتبار عقد العمل مفسوحاً من تلقاء نفسه أو مرقوفاً طيلة مدة الإضراب، الأمر الذي له تأثير على إستحقاق العامل المضرب وغير المضرب للأجر وملحقاته.
كما يتناول هذا الكتاب المسؤولية الناجمة عن ممارسة حق الإضراب يستوي في ذلك المسؤولية المدنية أو المسؤولية الجزائية للعمال المضربين، ونأمل أن نكون قد وفقنا في تقديم الجهود التي من شأنها أغناء المكتبة العربية في المسائل المتعلقة بحق الإضراب.
