مَنَّ الباري سبحانه على العباد أنْ أغناهم بالحلال عن الحرام وجعل النكاح وسيلة مادية ومعنوية لشرعية الإرتباط بين الرجل والمرأة... ولا يخفى أنَّ هناك مفردات قد تداخل بعضها مع البعض الآخر منها: الزواج، العقد، النكاح، فقد تُطلق إحداهما ويراد بها الأخرى، والمقصود واحد وهو تقرّب الرجل للمرأة وبالعكس بالسبب المشروع، وهو الممارسة الجنسيّة التي يهدف منها التوالد والتناسل والتمتع الفطري والأُنس الطبيعي، فهذه الأمور بما هي هي تقتضيها الفطرة الإنسانية من دون علاقة اللون واللسان والبلد والمكان بل ولا دخلّ فيها للمُعتقد.
