إن التأمين وسيلة استخدمها الناس منذ القدم لمعالجة آثار الأضرار والمخاطر والمصائب التي تنزل بهم، والتخفيف منها أو إزالتها تماماً.
وكل إنسان معرض دائماً لأنواع من المخاطر والأضرار قد تذهب بماله مما قد يحمله من الأعباء ما لا يستطيع، أو بحياته مما قد يعرض أهله للمعاناة.
وقد ازدادت الحاجة إلى التأمين بعد أن تخلت معظم الدول عن مسؤولياتها في تحقيق التكافل بين رعاياها، ومساعدة المحتاجين منهم، وبعد أن ضعف الوازع الديني عند الناس وما أعقب ذلك من تراجع في مجال التعاون بينهم، فظلاً عن تعدد أسباب الأخطار وجسامة آثارها.
واتسعت دائرة التعامل فيه لتشمل معظم أوجه النشاط الاقتصادي من تجارة وصناعة وزراعة، حتى أصبح التعامل به إن لم يكن إجبارياً بحكم القانون كالتأمين من المسؤولية المدنية المترتبة على حوادث المركبات فهو إجباري أيضاً بحكم الواقع لأن الأفراد لا يجدون في غيره وسيلة فعالة للضمان ضد المخاطر التي يتعرضون لها.
وبعد أن استقر الأمر على القول بحرمة التأمين التجاري بكافة أنواعه وجواز التأمين التعاوني واعتباره البديل الشرعي للتأمين التجاري، وذلك بقرار خاص صادر من المجمع الفقهي الإسلامي، كان لابد من التفكير بتطوير التعامل بالتأمين التعاوني، وإيجاد تصور جديد واسع له يسمح بتكوين شركات تأمين إسلامية يكون التأمين التعاوني محور عملها وأساس معاملاتها. ومن هنا جاء هذا البحث.
الذي كان قد سبق بدراسة خاصة عن التأمين التعاوني الإسلامي وتطبيقاته في شركة التأمين الإسلامية في الأردن نشرت بكتاب خاص وهي تمثل لسان حال الشركة في ممارستها للتامين الإسلامي من الناحيتين النظرية والعملية. وهي بالنسبة لهذا الكتاب أصله ونواته.
وتميز هذا الكتاب عنها بشمولية الطرح للفكر التأميني الإسلامي وممارساته في شركات التأمين الإسلامية، وتضمينه فصولاً جديدة أفرزت مادتها العلمية الندوات الخاصة بالتأمين وكذلك بعض الأبحاث والمحاضرات التي عقدت وأعدت بعد صدور الدراسة الأولى.
