تُعَدُّ الوظيفة العامَّة والموظَّف العام من الموضوعات المهمّة في الوقت الراهن، ويعود ذلك إلى تغيُّر دور الدولة بإتِّجاه زيادة تدخّلها في أغلب المجالات، الأمر الذي زاد من أهمية الوظيفة العامَّة والموظَّفين العموميين، على إعتبارهم الأساس في تكوين الدولة، وقوام أي مرفق عام وأهم عناصره.
هذا التحوُّل نتج عنه قيام الدول بوضع تشريعات، تحدِّد النظام القانوني لعمل هؤلاء الموظَّفين العموميين، بهدف إيجاد نوع من التوازن بين الحاجة إلى سَير المرافق العامَّة بإستمرار وإنتظام، وبين ضرورة ضمان حقوقهم.
وترجع أهمية تحديد طبيعة العلاقة القانونيَّة بين الموظَّفين العموميين بالإدارة العامة، إلى أنَّ نوع هذه العلاقة، هو الذي يحدِّد حقوق هؤلاء الموظَّفين وإلتزاماتهم تِجاه الدولة وسلطتها في مواجهتهم من جهة، وفي مسؤولياتها أمام الجمهور عن أعمال هؤلاء الموظَّفين من جهةٍ أخرى.
وعليه، تحاول هذه الدراسة الوقوف بشكلٍ دقيق على رؤية المشرّع العراقي للإشكاليات المنبثقة عن العلاقة بين الموظَّف العام والإدارة العامة، وما استقرت عليه القوانين المقارنة في كل من مصر ولبنان، وللوقوف على أوجه القصور في التشريعات الوظيفيَّة في تحديد طبيعة هذه العلاقة، بغية معرفة ما للموظَّف وما للإدارة من حقوق وواجبات متقابلة، ولضمان إيجاد توازن يتلاءم مع تمتّع الموظَّف العام بحقوقِه، وضرورة الإلتزام بأحكام الوظيفة العامة.
