تهتم الصكوك الدولية والإقليمية والقوانين الداخلية المتعلقة بمكافحة الإتجار بالبشر، بمسألة إلتزام الدولة بتعويض المجني عليه، نظراً لما يترتب على جريمة الإتجار بالبشر من أثار خطيرة، وخصوصاً أن طبيعة عمليات الإتجار بالبشر، من حيث كيفية القيام بها، من يقوم بها، وفرص ملاحقة الجناة وأموالهم ليست بالأمر الهين، الأمر الذي قد يجعل المجني عليه لوحده الذي يدفع ثمن الجريمة بالرغم من إنه ضحية لها، فضلاً عن إن إنتشار مثل هذه الجرائم، غالباً ما يكون بسبب الفقر والهجرة غير الشرعية وقلة فرص العمل، ضعف معدلات التنمية، وهي أسباب في الدولة لها نصيب كبير منها، الأمر الذي يؤدي إلى القول بضرورة أن تقوم الدولة بتعويض المجني عليه، إذا لم يستطع الحصول على تعويض من الجاني.
وسوف نعالج في هذا البحث أحكام تعويض ضحايا الإتجار بالبشر في قالنون المقارن، حيث سنعالج التعريف بعمليات الإتجار بالبشر وصورها، والتنظيم القانوني الدولى والداخلي لحقوق الضحايا، وطرق حصول الضحايا على التعويض، وذلك وفق خطة بحث تتضمن الآتي: (المبحث الأول: تعريف الإتجار بالبشر والأساس القانوني الدولي لتعويض ضحايا الإتجار بالبشر، المبحث الثاني: حقوق ضحايا الإتجار بالبشر وأساس الحق في التعويض، المبحث الثالث: ضحايا في عمليات الإتجار بالبشر، المبحث الرابع: طرق تعويض ضحايا الإتجار بالبشر في القانون الداخلي، المبحث الخامس: أحكام تعويض المجني عليه في عمليات الإتجار بالبشر في القانون المصري).
