تهدف هذه الأطروحة لتبيان حجم المشكلة الناتجة عن حرمان فئة اجتماعية من الميراث، رغم أن الإسلام قد أوصى بكفالة هذه الفئة ومساعدتها، ومن هذا الهدف يتفرع ثلاثة فروع هي: الظلم والحرمان الذي يلحق بالأحفاد، وتأثيره النفسي عليهم مما قد ينعكس سلباً على مستقبلهم، رغم أن الإسلام يأمر بإعلاء كرامة المسلم وتمكين عزته، الحقد والبغضاء اللذان ينشآن بين أفراد الأسرة الواحدة، ما قد يؤدي إلى قطع الأرحام التي حرص الإسلام على وصلها حفاظاً على متانة الروابط العائلية وصيانة لوحدة المجتمعات.
إلى جانب هذا تهدف هذه الأطروحة لتقديم الحل المناسب لهذه المشكلة مدعماً بالحجج النقلية والعقلية، ثم يتم إبراز المشكلة على أنها ليست ناتجة عن صور التشريع، وإنما القصور من المسلمين الذين اعتمدوا التقليد من الأحكام التي استنبطها أصاب المذاهب، وما كان ذلك ليكون لو كان المسلمون دولة موحدة، أو كان أصحاب المذاهب أحياءً، غذ لبادروا فوراً إلى إصدار الفتوى أو الحكم الذي يمنع الظلم.
وفي إطار تحقيق هذه الأهداف فقد تم تقسيم متن هذه الدراسة على مقدمة وثلاثة أبواب سلطت المقدمة الضوء على منهج البحث وأهميته وهدفه، أما الباب الأول فألقي الضوء على أحكام الوصية فتحدث عن مفهوم الملكية، تعريف الوصية، حكمتها، مشروعيتها، حكمها، تاريخ الوصية، وأخيراً فصل القول في أركان الوصية، ومبطلاتها، وبحث الباب الثاني من النسخ ومدى تأثيره على الوصية، وذلك بعد أن عرف بالنسخ وبين مشروعيته وحكمته، أما الباب الثالث والأخير فتحدث عن الوصية الواجبة ومدى تأثرها بالنسخ فبين ماهية الوصية الواجبة وتأصيلها، المسند الفقهي للوصية الواجبة، أحكام الوصية الواجبة.
