وأمام ما جاءت به الثورة التكنولوجية الحديثة "ثورة تكنولوجيا المعلومات" وما حملته في طياتها من تجديدات همت القطاع التجاري والمصرفي على وجه الخصوص، أصبح الحديث يدور عن ثورة أصغر وفي نطاق أضيق ألا وهي ثورة التكنولوجيا المصرفية التي اتخذت نتائجها وإفرازاتها تشق الطريق لتحتل مكانة ليست بالهينة في واقع العمل المصرفي، وإستحداثها وسائل جديدة للدفع والأداء فاقت في أهميتها الوسائل التقليدية المعروفة والتي اتخذت العديد من المسميات كالبطاقات اللدائنية والبطاقات البنكية... إلخ، لتأتي بذلك مثل هذه الوسائل تعزيزاً لعامل السرعة (بما يرتبه من توفير في الوقت والجهد) عماد العمل التجاري بوجه عام والمصرفي على وجه الخصوص.
فموضوع هذا الكتاب هو محاولة للبحث في الإطار القانوني لبطاقة الإئتمان إحدى أهم البطاقات البنكية التي عرفت إنتشاراً سريعاً ومهولاً نظراً لما تتيحه من سهولة ومرونة وفائدة في التعامل، وبصفة خاصة في المعاملات الإلكترونية بالنسبة لكل أطراف هذه العلاقة من خلال تحليله لأبرز الأنماط الجرمية التي تنطوي عليها ظاهرة الإستعمال غير المشروع لبطاقات الإئتمان (الإحتيال بالبطاقات) من حيث الآلية التقنية والفنية التي تعتمد عليها ومخاطرها ومدى شمول نصوص قوانين العقوبات لمواجهة أكثر صورها الإجرامية المستحدثة خطورة، بغية بيان الخصوصية الفنية التي ينطوي عليها نظام الوفاء والأداء بواسطة بطاقات الإئتمان...
ويتساءل الباحث هنا عن القواعد القانونية المنظمة لهذه الوسيلة الحديثة في التعامل وبالتالي عن مدى إهتمام المشرع بها، خاصة أنها بطاقة محفوفة بالمخاطر سواء على المتعاملين بها أو على الإقتصاد الوطني والدولي، وهو ما يستدعي أن تكون المعاملات بها محاطة بسياج من الضمانات القانونية لمجابهة أي إختراق للنظام الإلكتروني الذي تستعمل بواسطته هذه البطاقة.
