تعد البطاقات الائتمانية من الوسائل المستحدثة في المعاملات الإلكترونية، وباتت شائعة بين الأفراد، وأصبحت المؤسسات المالية تتهافت تحتاج إلى تسليط الضوء عليها ومعالجتها، وبناء عليه قمنا بتقسيم هذا البحث إلى ثلاثة فصول مهدنا لها بمبحث تمهيدي مستقل يتناول ماهية البطاقات المصرفية بشكل عام.
وبعد ذلك عرضنا في الفصل الأول ماهية بطاقات الائتمان الممغنطة وبيناً طبيعتها القانونية، ثم تناولنا العلاقات القانونية الناشئة عن استخدام البطاقات الائتمانية الممغنطة، والتي تنشأ بين المؤسسة المالية "مصدرة البطاقة"، والحامل، والتاجر الذي يقبل الوفاء بها، لنصل إلى أن البطاقات الائتمانية بطاقات ذات طبيعة خاصة ومستقلة عن الأوراق النقدية والتجارية.
أما في الفصل الثاني تعرضنا فيه للمسؤولية الجنائية عن الاستخدام غير المشروع لبطاقات الائتمان الممغنظة وذلك في مواجهة حاملها، حيث مهدنا لذلك بيان نظام استعمالها، وبحث الوسائل التي يمكن أن يسئ أو يتعسف حاملها في استخدامها، وأثرنا الآراء المختلفة التي ظهرت بشأن التكييف القانوني للمسئولية الجنائية الناشئة عن أفعال الشخص الحامل، وتوصلنا إلى أنه يمكن مساءلة حامل البطاقة عن أفعاله غير المشروعة أو إساءة استخدام بطاقاته الائتمانية الممغنطة.
وقد خصصنا الفصل الأخير لتبيان المسؤولية الجنائية عن الاستخدام غير المشروع للبطاقة أو دون رضاه، ومن المتصور أن يقدم الغير على استخدام البطاقة دون رضا الحامل الشرعي لها عن طريق استخدام البطاقة المفقودة أو المسروقة بالإضافة إلى فرضية تزوير البطاقات الائتمانية واستعمالها.
