يقع هذا المؤلف في خمسة أجزاء موزعة على النحو الآتي: الجزء الاول: للباب التمهيدي ولركن الضرر خاصة، والجزء الثاني: لركن الخطأ، والجزء الثالث: لرابطة السببية وإتفاقات الإعفاء من المسؤولية والتأمين منها، والجزء الرابع: لمسؤولية الإنسان عن فعل الغير، والجزء الخامس والأخير: لمسؤولية الإنسان عن فعل الحيوان وعن الأشياء غير الحية.
وسأعمد في هذه الأجزاء كلها إلى دراسة كل موضوع من موضوعاتها دراسة أقارن فيها موقف القوانين المدنية الوضعية من جهة مع موقف الفقه الإسلامي من جهة أخرى، بقدر ما يتسع له المقام والجهد.
وسوف أكثر من الإستشهاد بموقف القضاء الفرنسي والقضاء المصري بشكل خاص، مع عدم إغفال موقف القضاء العراقي كلما كان لقضائنا الوطني موقف خاص معين، لكنني لن أغلو في الرجوع إلى أحكام القضاء كي لا يكون هذا المبسوط الفقهي الجامع مجموعة من مجاميع أحكام القضاء مع بعض الشروح والتعليقات.
ولقد جاء هذا الكتاب ليكون شرحاً مبسطاً مستفيضاً لا للقواعد القانونية الخاصة بالمسؤولية كما وردت في التشريع الفرنسي أو في القانون المدني المصري، أو في القانون المدني العراقي، وإنما جعلته شرحاً مفصلاً لقواعد المسؤولية المدنية في قوانين البلاد العربية كلها، عرض فيه نصوص المسؤولية المدنية في قوانين الأقطار العربية (أردنية، وكويتية، وسورية، ولبنانية، ومصرية وليبية وتونسية وجزائرية ومغربية) إذ لم أدع نصاً من نصوص هذه القوانين ينطوي على حكم خاص متميز إلا وأشار إليه وشرح الحكم الذي ينطوي عليه، وبين في كثير من الحالات السبب الذي دفع هذا المشرع العربي أو ذاك إلى تبني هذا الحكم الخاص المتميز، وأردف ذلك - غالباً - ببيان رأى في هذا الحكم.
فهذا الكتاب الذي وضع بين يدي رجال القانون أخصصه لرجل القانون (العربي) وليس لرجل القانون (العراقي، أو المصري أو الأردني...) أنه شرح مبسط للمسؤولية المدنية في قوانين البلدان العربية كلها وليس شرحاً لقانون خاص من هذه القوانين.
