أرجو من خلال هذه الإطالة أن أبين غزارة الفقه الإسلامي بشأن مبدأ حصانة القاضي ضد العزل. ودحض كل قول مفاده أن مبدا عدم قابلية القاضي للعزل مبدأ حديث النشأة ومما يزيد في درجة فخرنا أن نظام الحكم في الشريعة الإسلامية يقوم على مبدأ الشورى وهو وحده كفيل بأن يحصن القاضي أكثر فأكثر ضد أي هوى قد يراود الإمام فقبل أن يبادر هذا الأخير إلى عزل قاضي معين يلجأ لمشاورة من يراهم أهلاً للإستشارة فيعرض عليهم أمره وقراره. وذلك لخطورة العزل وما قد يترتب عليه من آثار تمس ضوابط المصلحة. والحديث عن هذا الموضوع يأتي في فصلين كما يلي: (الفصل الأول: العريف بالقضاء وبيان أهميته واستقلاله، الفصل الثاني: حالات إنعزال وعزل القاضي).
