التحكيم هو إحدى الوسائل البديلة لتسوية المنازعات وإن كان الوسيلة الوحيدة بين تلك الوسائل التي تتمتع بالطابع الإتفاقي إبتداءً والطابع الجبري إنتهاءً. والتحكيم بهذا المعنى مصدره الإتفاق؛ ومن ثم فهو ذو طبيعة رضائية. والمشرع المصري نظم التحكيم في قانون المرافعات المدنية والتجارية الصادر بالقانون رقم 77 /1949 الذي ألغى بقانون المرافعات الحالي رقم 13/ 1968 حيث تضمنا النصوص الخاصة بالتحكيم قبل وبعد إنضمام مصر إلى إتفاقية نيويورك بشأن الإعتراف وتنفيذ أحكام المحكمين الأجنبية. وإختيار مصر طريق الإستثمار للتنمبية الإقتصادية الذي لا يطمئن إلا لوجود نظام تحكيمي على نسق الأنظمة الدولية أدى إلى مناداة الفقه ومراكز التحكيم الدولية ورجال الأعمال الوطنيين والأجانب بضرورة إصدار قانوناً مستقلاً للتحكيم يتواءم مع الإتفاقيات الدولية كإتفاقية نيويورك والقانون النموذجي للتحكيم التجاري الدولي.
وقد عالجت الدراسة الماثلة (إهدار المبدأ الإتفاقي للتحكيم في قانون سوق رأس المال رقم 95/ 1992 في منازعات المتعاملين في الأوراق المالية) في فرعين، أولهما عن التحكيم الوطني وإتجاهات التحكيم الدولي المعاصرة، وثانيهما عن تسوية المنازعات في القوانين الإقتصادية المصرية بواسطة التحكيم الإتفاقي أو الإلزامي.
