اعتاد الفقه الجنائي العسكري أن يتناول النيابة العسكرية عبر قانون الأحكام العسكرية، مكتفيًا بنصوص هذا القانون وحده– على عكس الفقه الجنائي العام، الذي يتناول النيابة العامة لذاتها في مصنفات خاصة، ويعطي اهتمامًا كبيرًا لتعليمات النائب العام– حتى أننا نجد كتبًا تتحدث عن هذه التعليمات في المسائل الجنائية، وأخرى تتناولها في المسائل الإدارية والتنظيمية. وجاءت الفكرة باقتباس وتطبيق ما يحدث في الفقه العسكري، وتطبيق ذلك على النيابات العسكرية؛ وذلك لأن التعليمات العامة للمدعي العام العسكري للنيابات العسكرية أمر لا يتطره له الشراح. في حين أن هذه التعليمات– عسكريًا– تعادل تعلميات النائب العام للنيابات العامة. يعد هذا الكتاب أول مصنف يهتم بتفريد وشمول أعمال النيابات العسكرية، ويفسح– في ذات الوقت– الطريق أمام العاملين والباحثين والمحامين للتعرف على تعليمات المدعي العام العسكري.
