فإستخدام القوة يشكل إهتزاز مستمر في علاقات الدول وإستقرارها مع تزايد هذه النزاعات المسلحة والتدخلات الدولية والإعتداءات غير المشروعة المخالفة للقانون، هذه الحقائق في عصرنا الراهن تؤشر تحدياً حقيقياً للقانون الدولي الإنساني وللإعتبارات الإنسانية في إطارها النظري والعملي عندما تطبق وتفسر خارج قواعدها من قبل الأفراد والمنظمات والدول مُشَّكلة إنتهاك للقانون وآلياته الكفيلة بإحترام وضمان حقوق الأفراد والجماعات والدول فترة النزاعات المسلحة الدولية وغير الدولية، وحالة الضرورة العسكرية في النزاع المسلح من أكثر الموضوعات تعقيداً وإثارة وذلك من خلال الإشكاليات التي تثيرها فكانت الضرورة مثار إهتمام الفقه والقضاء لها أهميتها البالغة في كل أطوار الحياة الإنسانية.
وعليه، من المناسب الوقوف عند هذه الحالة وتبيانها لخطورتها إذ للدول حق ممارستها عند وجود خطر حقيقي يهدد إستقلالها وكيانها السياسي وأمنها، وتكون عملاً مشروعاً في حالة ليس هناك وسيلة أخرى لإيقاف هذا الخطر إلا باللجوء إليها، وبالتالي عليه مناقشة هذا الموضوع مناقشة قانونية للوقوف على حقيقتها وآراء الفقهاء.
من هنا، يتناول هذا الكتاب هذا الموضوع المهم لتبيان مفهوم الضرورة العسكرية وشروطها وطبيعتها القانونية وإختلاف النظرة التشريعية إليها، سيما وأن الإتفاقيات الدولية واللوائح القانونية تضمنت نصوصاً تشير للضرورة العسكرية وبالذات أثناء النزاعات المسلحة فالعمل على التوعية لتفادي النزاع المسلح بالإتجاه السليم المعبر عن إحترام الإنسان وحب الحياة في كل جوانبها ومفاصلها وإتجاهاتها، والتوق لعالم مستقر متعاون متكافل يبني ويعمل لمستقبل أفضل وحياة أزهر وإنسان أسعد.
