اصطلح الفقهاء على أن عقد التأمين يلزم المؤمن بأن يؤدي للمؤمن له مبلغاً محدداً أو إيراداً مرتباً عند وقوع خطر ما، خلال مدة معينة مقابل قسط التأمين الذي يؤديه المؤمن له للمؤمن. ومع تزايد التطورات في شتى مناحي الحياة وبازدياد الكوارث والمخاطر حصل تطور كبير في مجال عمليات التأمينات وعقوده وصوره وقد صحب ذلك بروز واقع قانوني جديد ينبغي التعامل معه بتبصر. ومع كل ذلك فقد ظل موقف الفقهاء والباحثين المسلمين غير مبال بالتأمين وعملياته حتى وقت قريب. وفي حين أن عقد التأمين محرم عند فريق فقد ذهب فريق آخر إلى مشروعيته ولكل أدلته وبراهينه وحججه.
والدكتور عبد الهادي الحكيم واحد من الذين أدلوا بدولهم في هذا الموضوع عن دراية وعلم فجاء مؤلفه هذا دراسة مقارنة شاملة عكس فيها آراء المذاهب الإسلامية المختلفة فتناول عقد التأمين تجارياً كان أو تبادلياً أو تعاونياً، محدداً طبيعته وذاكر خصائصه وقد جاء كتابه في مقدمة وتمهيد وبابين وتسعة فصول. عرض في التمهيد لنشأة التأمين وتطوره عبر مراحله المختلفة، أما الباب الأول فقد فصّل فيه أركان عقد التأمين الثلاثة وهي التراضي والمحل والسبب. كما بحث في تقسيمات التأمين من حيث العموم والخصوص وتقسيمه من حيث الأخطار المؤمن منها، ومن حيث الموضوع والغرض ومن حيث قوة التطبيق.
أما الباب الثاني فتناول فيه المؤلف "مشروعية ولزوم عقد التأمين التبادلي والتعاوني والتجاري". وقد انتهى المؤلف أن عقد التأمين لا يختلف عن سائر أنواع العقود الأخرى من حيث الأركان كما أنه ينقسم إلى تقسيمات متعددة فهو ينقسم إلى تأمين اجتماعي وتأمين خاص، أما من حيث الأخطاء المؤمن منها فينقسم إلى تأمين بري وتأمين بحري وتأمين جوي ومن حيث المضمون فينقسم إلى تأمين على الأشخاص وتأمين من الأضرار.
