كان إجراء انتخابات حرة نزيهة شفافة، لانتخاب أعضاء المجلس التشريعي الفلسطيني، إنجازاً يحسب للسلطة الفلسطينية، ونموذجاً حضارياً في العلاقة بين القوى والتيارات الفلسطينية المختلفة، قل نظيره في العالم العربي.
غير أن "الفرحة لم تتم" عندما بدأت حرارة الاختلاف في التصاعد بين طرف شعر أنه خسر شيئاً يملكه، ويردي استرداده بأسرع وقت، وبين طرف شعر أنه حاز على ثقة الشعب، ويريد أن يستلم الصلاحيات ويحقق الإنجازات بأسرع وقت.
اختفظت فتح بسيطرتها على منظمة التحرير الفلسطينية، وعلى منصب رئاسة السلطة، كما احتفظت بسيطرتها عملياً على الأجهزة الأمنية، وعلى جهاز الخدمة المدنية، بينما سيطرت حماس على المجلس التشريعي وعلى حكومة السلطة. ودخل الطرفان في صراع على الصلاحيات، خسر فيه الطرفان، وعانى معهما الشعب الفلسطيني، في الوقت الذي سعت فيه "إسرائيل" والولايات المتحدة لتأجيج الخلاف وتغليب طرف على آخر.
يحاول هذا الكتاب، تقديم دراسة موضوعية لصراع الصلاحيات بين فتح وحماس في أثناء قيادتهما لمؤسسات الحكم الذاتي، منذ أن فازت حماس في الانتخابات في 25/1/2006، وحتى تشرين الأول/أكتوبر 2007. ويسلط الكتاب الضوء على الجوانب القانونية، وكيف تم توظيفها من قبل الطرفين. ولأن الساحة الفلسطينية تشهد حالة من الشد والتنافر بين قطبيها (فتح وحماس)، فإن مثل هذه المواضيع تكتسب حساسية خاصة، حيث إن لكل طرف رؤيته وروايته، ولذلك فقد سعت الدراسة قدر الإمكان إلى تقديم طرح موضوعي موثق ومتوازن.
