بادئ ذي بدء تتألف الهيئة العامة في محكمة النقض من سبعة مستشارين من الدائرتين المدنية والجزائية في المواد المدنية والتجارية والجزائية، ومن الدائرتين المدنية والشرعية على أن يكمل النصاب من باقي مستشارين محكمة النقض بتكليف من الرئيس. ويرأس رئيس محكمة النقض الهيئة العامة، وعند تعذر ذلك يرأس الهيئة العامة نائب الرئيس أو المستشار الأقدم. وتنظر الهيئة العامة لمحكمة النقض في الدعوى التي تحيلها اليها احدى دوائر المحكمة اذا رأت هذه الدوائر العدول عن مبدأ قانوني قررته أحكام سابقة. وفي هذه الحال تصدر الهيئة أحكامها بالعدول بأغلبية خمسة مستشارين على الأقل. نتيجة لما سبق تعتر قرارات الهيئة العامة لمحكمة النقض إنما هي بمنزلة القانون لا تجوز مخالفتها بأية حالة من الأحوال (قواعد آمرة). وبالتالي فإن جميع محاكم الموضوع علامة باتباعها والأخذ بها في القضايا التي تعرض عليها. ونظراً لأهمية الموضوع قررنا أن نضع بين يدي الباحث القانوني مجموعة القواعد القانونية التي قررتها الهيئة العامة لمحكمة النقض في شتى المجالات والمواضيع المختلفة، الجزائية والمدنية والشرعية والتجارية ومخاصمة القضاء).
