يشكل هذا الكتاب دراسة قانونية في ظاهر القضاء الجنائي الدولي المتمثل حديثاً بـ (المحكمة الجنائية الدولية) وخاصة بعد الحرب العالمية الثانية وما حدث من صراعات عسكرية بعد هذا التاريخ، كشفت للعيان عن أن الصراعات المسلحة هي أمر لا يمكن تجنبه مهما بذلت الجهود. من هنا تأتي أهمية القضاء الجنائي الدولي الذي يعمل على ضرورة احترام القانون الدولي الإنساني إبان هذه الصراعات، وبل أكثر من ذلك، كما يرى المؤلف "ضرورة محاكمة مجرمي الحرب ووجوب العمل على إنشاء محكمة جنائية دولية. وهو الأمر الذي تحقق بالفعل في إقدام مجلس الأمن على إنشاء محكمة دولية لمحاكمة مجرمي الحرب في يوغسلافيا وأخرى لمجرمي الحرب في راواندا. وتم التوصّل إلى إقرار نظام روما الأساسي للمحكمة الجنائية الدولية في 17 / تموز / 1998م والتي تعتبر جرائم الحرب ومحاكمة الفاعلين بها من أهم الإختصاصات الموكولة إليها".
وعليه، يتناول هذا الكتاب المحاكم الجنائية الدولية ونشأتها وطبيعتها بالدراسة والتحليل ضمن بابين: الباب الأول: في تحدي طبيعة المحكمة الجنائية الدولية واساسها القانوني وتشكيلاتها وأحكام العضوية فيها وفقاً لميثاق روما الأساسي وقواعد القانون الدولي الأخرى، والباب الثاني: في ضمانات المتهم في التشريعات الوطنية والدولية وفي ميثاق روما الأساسي.
