مما لا شك فيه ان تطور احكام قانون العمل مرتبط إلى حد بعيد بتطور تلك العلاقات الجماعية.
فقيام نقابات العمال وازدياد قوتها باعتبارها ممثلة لرغبات ومصالح العمال، أثر إلى حد كبير في تطور روابط العمل بحيث أصبح من المتعذر دراسة روابط العمل دون ان يؤخذ في الإعتبار مدى ما وصلت إليه الحركة النقابية في بلد ما من قوة ومن تنظيم.
ولا يقتصر دور النقابة على إبرام عقود العمل الجماعية، بل يمتد دورها إلى ما بعد إبرامه، لمراقبة تنفيذه ولحماية المستفيدين من شروطه، سواء أكانوا من أعضاء النقابة، او مجرد عمال غير نقابيين ممن شملهم الإتفاق. فلو ثار خلاف حول تطبيق العقد الجماعي في مجمله او في بعض بنوده فإن النزاع في هذه الحالة لا يحل عن طريق التقاضي بالطرق العادية.
ذلك ان حل هذه الانزعة الجماعية له وسائلة الخاصة إما عن طريق لجوء العمال إلى استخدام حق الإضراب، لإرغام صاحب العمل على الاستجابة لمطالبهم ، أو لاستخدام الطرق الخاصة التى قررها المشرع لتسوية هذا النزاعات، كالتوفيق (أو الوساطة) والتحكيم في منازعات العمل.
