Book Description
يتسم تشريع لعمل في القطر العربي السوري بحداثة العهد، فالقانون 279 لعام 1946، كانون أول التنظيم وطني يصدر في هذا المجال، ولكن فترة العمل به كانت قصيرة جداً. وهكذا فما كادت مهمة شرحه تبدأ حتى لغي واستبدل بقانون العمل الموحد رقم 91 لعام 1959. وقد كان الأستاذ الدكتور فؤاد دهمان أول الرواد في القطر لشرح هذا التشريع الأخير في كتاب جامعي، ظل خلال عقد من السنين المرجع المحلي الوحيد لطلاب الحقوق والمعنيين بأمور العمل من قضاة ومحامين وإداريين، مما استوجب طبعه مراراً.
ومنذ أن أنيط بالدكتور "محمد فاروق الباشا" النهوض بتدريس مقرر قانون العلم، سعى إلى وضع هذا المؤلف ليكون بين يدي الطلاب أداة جامعية تتعمله تتصل وتتكامل مع مؤلف الأستاذ "دهمان" حتى يحيط المؤلف بكافة جوانب موضوعه عمد إلى تقسيم كتابه إلى قسمين خصص أولهما لصياغة وشرح مؤسسات أربع أسهم كل منها في تطوير علاقات العمل وفي إرساء تنظيمها الحقوقي بالمضامين التي نعيشها اليوم.
وهذه المؤسسات هي التالية: المؤسسة التاريخية أو التنظيم المهني لعلاقات العمل. المؤسسة النقابية أو الإسهام النقابي في تنظيم علاقات العمل. المؤسسة الدولية أو التنظيم الدولي لعلاقات العمل، المؤسسة التشريعية، أو التنظيم القانوني لعلاقات العمل، أما القسم الثاني فافرده ليشرح فيه علاقات العمل وفقاً لأحكام القانون رقم 91 لعام 1959، النافذ في القطر العربي السوري، وبالتالي تحدث عن الأحكام القانونية العامة لعقد العمل الفردي، آثار عقد العمل وتنظيم علاقاته، وقف وانتهاء عقد العمل والآثار المترتبة عليها المنازعات والتحكيم في عقد العمل.
