ظلت علاقات العمل في المملكة الأردنية الهاشمية محكومة بالقانون رقم 21 لسنة 1960 لمدة تقارب ست وثلاثون عاماً وخلال هذه الفترة ظهرت بعض أوجه القصور في الجوانب العملية والتطبيقية، إضافة إلى عدم انسجامها في بعض الحالات مع اتفاقيات العمل الدولية التي صادقت عليها المملكة الأردنية، الأمر الذي جعل المشرع الأردني يبادر بإصدار قانوناً جديداً رقم 8 لسنة 1996م ليواكب التطورات التي شهدها المجتمع الأردني ويسد به الثغرات التي تضمنها القانون القديم وتعديلاته، وكذلك حتى يضمن حقوق ومزايا الطبقة العاملة التي يزداد عددها في المجتمع.
كل هذه الاعتبارات جعلت المشرع الأردني يسن القانون الجديد المذكور أعلاه، ولكن بالرغم من صدوره ظهرت أوجه القصور مما جعل المشرع الأردني يصدر عدة تعديلات لاحقة لهذا القانون.
والواقع أن دراسة هذا الفرع من فروع القانون تحتاج إلى الوقت والجهد لأمرين الأول قلة المؤلفات التي تناولت هذا الفرع بكافة تفصيلاته والثاني عادم وجود أي مؤلف من هذا المؤلفات مواكباً للتعديلات الجديدة التي طرأت على هذا القانون بل أن جميعها اقتصر على شرح القانون رقم 8 لسنة 1996م دون تناول هذه التعديلات.
ونظراً لهذا فقد وجدت نفس متلهفاً إلى الكتابة في هذا الفرع واضعاً نصب عيني أن تكون مواكبة لآخر هذه التعديلات لسنة 2002 وأن تكون مدعمة بالجانب التطبيقي سواء أحكام التمييز الأردنية أو النقض المصرية بالإضافة إلى أحكام قانون الضمان الاجتماعي رقم 19 لسنة 2001م وتحقيقاً لمصلحة الطلاب الدارسين والباحثين والمشتغلين بالقانون فقد اقتصرت على شرح أحكام قانون العمل والضمان الاجتماعي في المتن، أما المقارنات فقد جعلت محلها الهامش إذ هي تثري الفكر القانوني لدى الطالب والباحث والمشتغلين بهذا الفرع.
وهذا المؤلف هو محاولة يسيرة في هذا الفرع من فروع القانون الذي قلت الكتابة فيه أملاً أن يساهم في سد ثغرة صغيرة في المكتبة القانونية العربية.
