أنَّ الدراسات والأبحاث التي تناولت جريمة القتل الخطأ وبالرغم من كثرتها، إلا أنها افتقرت إلى إعطاء التشريع الجزائي الإسلامي حقّة في معالجةِ هذه الجريمة، حيث إنَّه لم يتمّ تسليط الضَّوء على الجانب الشرعي بالقدر الكافي، فضلاً عن عدِم بيان آراء المذهب الإمامي حول هذا الموضوع.
ولهذا فقد تناولت هذه الدراسة، في القسم الأول التعريف بجريمة القتل قانوناً وشرعاً، والخطأ غير المقصود قانوناً وشرعاً، وفي القسم الثاني أركان جريمة القتل الخطأ، وجزاءاتها قانوناً وشرعاً، حيث تبرز أهمية هذه الدراسة من خلال تسليط الضوء على أوجه التشابه أو التباين بين القانونين الجزائيين العراقي واللبناني من جهة وبيان الآراء الفقهية في التشريع الجزائي الإسلامي حسب المذاهب الإسلاميَّة: الحنفيَّة، والمالكيَّة، والشافعيَّة، والحنبليَّة، والزيديَّة، والإماميَّة، وأوجه التشابه أو الإختلاف في ما بينها وكذلك أوجه التشابه أو التباين بين التشريع الجزائي الوضعي مع التشريع الجزائي الإسلامي، من حيث مفهوم جريمة القتل غير المقصود (القتل خطأ) من جهة أخرى.
كذلك تظهر أهمية هذا الموضوع من خلال معالجة الجرائم الحديثة، الجرائم الإيجابية منها والسلبية، التي تدخل في نطاق جريمة القتل غير المقصود والأحكام القضائيَّة المختلفة الصادرة عن القضاء اللبناني، وعن القضاء العراقي، التي تناولت موضوع جريمة القتل غير المقصود (القتل خطأ)، والتي تختلف في ما بينها، نظراً لإختلاف الآراء، وتعدُّد النظريات الفقهيَّة التي تناولت هذا الموضوع، من قبيل جرائم القتل الخطأ الناجمة عن قيادة المركبات وعن إطلاق العيارات النارية وجرائم القتل نتيجة الغرق وغيرها من جرائم القتل غير المقصود.
