تحدّثتْ هذه الدراسة عن توثيق الصّكوك في الشريعة الإسلامية والقانون، وأبرز أحكامها، بأسلوب علمي قائم على إتباع المنهج الوصفيّ، مع الإستفادة من منهجي البحث العلمي الإستقرائي والإستنباطيّ.
وجاءت الدراسة في مقدمة وتمهيد وثلاثة فصول وخاتمة.
تناول التمهيد: توثيق الصّكوك في الإسلام، والتعريف بعلم الشّروط، وبيان أهمّ المؤلّفات فيه، ففي الفصل الأول: خُصِّص للحديث عن مبادئ علم التوثيق حيث تضمن تعريف علم التوثيق، وموضوعه، ومسمياته، واستمداده، وطرق التوثيق، وحكم التوثيق، والتوثيق بأجهزة الإتصال الحديثة.
وكان من أهمّ نتائجه، أنّ التوثيق بوسائل الإتصال الحديثة مشروع، الفصل الثاني: تحدّث عن أحكام الموثّق والوثائق حيث تضمن تعريف الموثّق وحكم التوثيق بالنسبة له، وشروط الموثّق، وأُجرته على كتابة الصّكوك وتنظيمها، واختصاصات الموثّق، وطرق انتهاء ولايته، وأنواع الوثائق والصّكوك.
وكان من أهمّ نتائجه: أنّ التوثيق بالنسبة لصاحب الحقّ مندوب وهو الراجح، وأنّ التوثيق بالنسبة لكاتب الصّكوك مندوب، وأنّه يجوز لكاتب الصّكوك أن يأخذ أجرة على كتابة الصّكوك وتوثيقها.
الفصل الثالث: تحدّث عن حجيّة الصّكوك في الإثبات وكيفيّة الطّعن فيها، وحكم الصّكوك في الشريعة الإسلامية، وحكم الصّكوك في القانون.
