ان كل نوع من انواع هذه العقود، كما هو واضح، محكوم بقانون يختلف عن الآخر، ومن ثم يخضع بالضرورة لأحكام ومبادئ وإجراءات قانونية مختلفة عن غيره من العقود الأخرى. وعلى سبيل المثال- بينما يخضع العقد المدني (عقد البيع أو الإيجار، مثلا) لإدارة أطرافه فقط، نجد أن العقد الإداري (عقد الأعمال الإنشائية مثلا) يخضع لقواعد ولوائح وإجراءات معينة، بدءا بضرورة الإعلان عن العقد في مناقصة عامة ومروراً بضرورة إتباع إجراءات معينة في تقديم العطاءات وتوفر شروط معينة لترسية العقد، وانتهاءا باجراءات التعاقد، بل إن وثائق العقد نفسها تختلف من عقد لآخر حسب نوع العقد، فبينما لا يتطلب العقد المدني سوى وثيقة الاتفاق فقط- نجد أن وثيقة الاتفاق في العقود الإدارية لا تخرج عن كونها نموذجا يتم استيفاؤه من جانب المتعاقد مع جهة الإدارة لاستكمال وثائق العقد. ويسبق هذا النموذج في الأولوية قائمة طويلة من الوثائق الأخرى، مثل كراسات الشروط الخاصة باجراءات تقديم العطاءات، وشروط التأهيل، والشروط العامة للعقد، ونماذج التأمينات، والرسومات، والمواصفات، إلخ.
نظرا لتعدد الوثائق التى تعتبر جزءا متمماً لبعض أنواع العقود (العقود الادارية) وتنوع موضوعات البعض الآخر بشكل يصعب حصره (العقود المدنية)، فإن مسألة مناقشة كل أنواع العقود معا في كتاب واحد سيؤدى حتما إلى أحد احتمالين كلاهما مكروهين، وهما: التقصير المضر، أو التطويل الممل.
