إذا امعنا النظر في فروع القانون المختلفة نجد ان القانون التجاري هو اول الفروع التى يتعين البدء في دراستها من اجل توحيدها، ذلك لأن تشجيع التبادل التجاري فيما بين الأفراد وبين الشركات داخل نطاق دول التعاون يتطلب توحيد الأنظمة والقوانين التجارية المطبقة في هذه فاختلاف الأنظمة والقوانين وتباينها ، ربما يضع عقبات في مواجهة القانون التجاري ، ويؤدي في النهاية الى عرقلة الأعمال التجارية بين الاشخاص. لذلك يهدف البحث إلى دراسة مدى إمكانية توحيد الأنظمة والقوانين المنظمة لممارسة التجارة والصناعة في دول مجلس التعاون الخليجي عن طريق التعرف على أوجه الشبة وأوجه الاختلاف بين هذه الأنظمة والقوانين والتقريب بينها بغية الوصول إلى النظام القانوني الموحد الذي يستند إلى احكام الشريعة الإسلامية الغراء.
