Book Description
يقصد بالتأمينات العينية مجموعة الوسائل التي تضمن الدائن من خطر عدم إيفاء الدين في موعد استحقاقه وتتيح له استيفاء الدين في هذا الموعد.
ويتم بمقتضاها تخصيص مال معين أو أموال معينة لضمان إيفاء الدين عند استحقاقه ومن هنا تأتي أهمية دراستها مقارنة مع التأمينات الشخصية التي تقوم على انضمام ذمة مالية أو أكثر إلى ذمة المدين بحيث تصبح الأموال الداخلة في هذه الذمم مجتمعة ضامنة لوفاء الدين عند استحقاقه.
إنّ التأمينات العينية التي أجاز القانون إنشاءها هي التأمين والرهن والامتياز.
ولكل منها مفهومه وخصائصه ومفاعيله وأسباب انقضائه التي تميزه عن غيره وأن تشابهت في بعض الأحيان.
لقد تناولت في هذه الدراسة التأمينات العينية العقارية فقط واستبعدت رهن المنقول باعتبار أنّه من العقود المسماة الذي نظمه قانون الموجبات والعقود في ملحق به وذلك بالمرسوم الاشتراعي رقم 46/ل الصادر في 20/10/1932 والمصدّق عليه بالقرار التشريعي رقم 154/LR الصادر في 7/11/1932.
مخصصة جزءاً من هذه الدراسة للتأمين العقاري مقارنة مع الرهن العقاري وجزءاً آخر لدراسة البيع بالوفاء أو الرهن الناقل للملكية وخلصت إلى دراسة الإمتياز وخصوصيته بالنسبة للتأمين والرهن العقاري فعالجت مفهومه وخصائصه ومفاعيله وأنواعه وأسباب انقضائه وأثر الإفلاس عليه.
متمنية في النهاية أن يلقى هذا الكتاب استحساناً من القارئ. وأن يشكل إضافة إلى المكتبة الحقوقية والله ولي التوفيق.
