تشكل نظرية الأموال أحد الموضوعات الرئيسية من مواضيع القانون المدني باعتبار أن هذا الأخير يرعى العلاقات المالية بين الأفراد. والأموال هي الأشياء التي تقبل التداول كما وأنها تقبل التقدير.
تقسم الأموال إلى أموال منقولة وأموال غير منقولة وهذا التقسيم عام وشامل كل الأشياء والحقوق في القانون اللبناني، غير أن هذا التقسيم ليس الوحيد، بل إن هناك معايير أخرى لتقسيم الأموال. والأشياء والأموال قد تكون مادية، وقد تكون أشياء وأموال غير مادية وهي الحقوق مالية أو غير مالية.
تقسم الحقوق المالية تقليدياً إلى حقوق عينية وحقوق شخصية وفي مواجهة هذا التقسيم التقليدي ظهرت إتجاهات فقهية حديثة في قسم الحقوق. إن الحديث عن الحقوق يقودنا إلى دراسة صاحب الحق أكان شخصياً طبيعياً أو شخصاً معنوياً وسمات الشخصية القانونية سيما نظرية الذمة المالية التي ظهر في تعريفها نظريتان، وقد تبنى القانون اللبناني نظرية وحدة الذمة المالية وما يترتب عليها من نتائج.
يستفاد مما عرضت له أن نظرية الحق والذمة المالية وتقسيمات الأموال تشكل الموضوعات الرئيسية التي عرضت لها في هذا الكتاب وقد مهدت لدراسة هذه الموضوعات بمقدمة عالجت فيها أحكام القاعدة القانونية والقانون باعتبار أن هذه الدراسة هي دراسة قانونية لا يتمكن الطالب من فهمها إلا بعد الوقوف على معنى القاعدة القانونية والقانون ومصادرهما آملة أن تشكل هذه الدراسة حجر الأساس من البناء القانوني السليم للطالب الذي يدرس القانون المدني في معرض دراسته الحقوقية.
