وكما أنه من المسلم به اليوم أن من مقتضيات الأعمال المصرفية شبه اليومية إنشاء الرهونات والـأمينات العقارية حتى تاريخ استحقاق مواعيد الوفاء والسداد، وإلا لجأت المصارف إلى التنفيذ العيني على العقارات المرهونة والمؤمن عليها استيفاء لحقوقها التي تحفظها هذه الضمانات العينية العقارية عند الاقتضاء.
