عن أهم الحريات والحقوق التى يجب كفلها للإنسان في مجتمعه " الحرية الشخصية"، فهى متوقف عليها باقي الحريات فلا يعقل أن يحرم الإنسان منها ويحفظ له ما هو غيرها. في "الحرية الشخصية" التى نرايد اهتمام الدول والقوانين بها في عالمنا المعاصر.. وضع الدكتور "أشرف توفيق شمس الدين" تلك الدراسة، وفقها يقوم بتتبعها في الدول المختلفة وعمل مقارنة بينها. فيبدأ في الباب الأولبعد ان يوضح ما هيتها وأزمتها وعلاقتها بامن واستقرار المجتمعات.. ما يتعلق بها في إعلانات حقوق الإنسان والاتفاقات الدولية ، يتعرض بعدها إلى الحرية الشخصية في الدساتير المختلفة.. فمثلا الدستور المصري يشمل ما قبل دستور 1971م وما بعدها ثم في باقي الدساتير.. ثم يتناول "الحرية الشخصية" في قوانين العقوبات المختلفة أما ما يلي ذلك فهو تناول فكرة الحرية الشخصية ذاتها وفقا للأساس الفلسفي ومضمونها فكرة الحرية الشخصية ذاتها وفقا للاساس الفلسفي ومضمونها وعناصرها والباب الثاني يقوم فيه بتوضيح أفعال الإعتداء على الحرية الشخصية.
