إذا كانت الأنظمة الإجرائية المقارنة قد إختلفت في تحديد السلطة التي تتولى التحقيق الإبتدائي، وما إذا كان يجب أن يعهد بها إلى قاض أم تتولاها النيابة العامة أو أن تترك إلى الشرطة؛ فإن النظام الإجرائي الجرماني قد إنحاز بجلاء إلى النيابة العامة، بحسبانها السلطة المهيمنة على التحقيق الإبتدائي والإتهام؛ بل وعهد إليها باختصاصات واسعة في الدعوى الجنائية.
وقد احتلت النيابة العامة في نظر الفقه والتشريع الألمانيين مكانة كبيرة، وارتبطت دائماتً بجهود إصلاح وتطوير الإجراءات الجنائية. وعلة ذلك أن التسؤلات التي تطرحها جهود الإصلاح تتوقف الإجابة عليها إلى حد كبير على المركز القانوني للنيابة العامة ودورها في الدعوى الجنائية.
