دفعنا إلى كتابة هذا البحث ، الذى لا يعدو ان يكون جزئية في مؤلف كنا نزمع إصداره في نظرية الإثبات - ، هول ما رأيناه في الأحكام التى يصدرها قضاة الموضوع بندب الخبراء في الدعاوى التى ترفع إليهم فهذه الأحكام تصدر، حينا ، لمناسبة ، وأكثر الأحيان لغير مناسبة ، وتصدر ، مرة ، متفقة مع القانون ، وأكثر المرات مخالفة لقواعده، بل ولأبسط مبادئه. فبينما تتحدد مهمة الخبير ، وفقا لعبارة محكمة النقض "في المسائل الفنية التي لا يستطيع القاضي إدراك كنهها بنفسه فإن الأحكام بندب الخبراء كثيرا ما تعهد إليهم بمسائل قانونية لا ولاية فيها إلا للقضاة ، ولا يجوز أن تكون موضوعا للخبرة. والأخطر من هذا ، واعمق إيغالا في مخالفة القانون ، أن قضاة الموضوع كثيرا ما يعمدون، تحت ستار الخبرة، إلى تفويض سلطتهم القضائية ، صراحة ، في تحقيق الدعوى ، بل واحيانا، بطريقة ضمنية ، في الفصل فيها ، إلى الخبير ، الذى يكون ، في الحقيقة، مفوضا عاما بالسلطة القضائية ، ليكتفي القضاة بجعل ما إنتهى إليه الخبير منطوقا لحكمهم ، ومن تقريره أسبابا له ، لتنتقل سلطة الفصل في الدعاوى إلى الخبراء ، وهم ليسوا من رجال القانون ، ولا تتوافر فيهم ضمانات القضاة. ويبعث حقيقة على السى ، ان يعهد قضاة الموضوع إلى الخبراء بما لا يستطيعون هو أنفسهم القيام به ، لخروجه عن حدود وظيفتهم ، وهو التصريح للخبير بالتنقيب ، او البحث عن الأدلة " في أية جهة حكومية أو غير حكومية"- ، بعبارات واحدة في كل الأحكام ، رغم أن فاقد الشئ لا يعطية كما يقول علماء الأصول. لذلك ، قصدنا بهذا البحث وضع الأمور في نصابها القانوني الصحيح ليعود قضاة الموضوع إلى الألتزام به ، ويصر المحامون على المطالبة بتنفيذه.
