بالرغم من أن موضوع التحكيم قد تناولته العديد المؤلفات القانوينة من زوايا مختلفة - إلا أننا وجدنا أن ذلك لا يحول دون تناول موضوع مفهوم الأثر السلبي للإتفاق على التحكيم، والوسيلة الفنية لإعماله "الدفع بالتحكيم"، والخلاف الفقهي بصدد تحديد طبيعتها، تحقيقاً لمزيد من الفائدة العملية، والتي أرجو أن يوفقني الله - تبارك وتعالى - إلى تحقيقها، فيرتب الإتفاق على التحكيم آثاراً قانونية عديدة في ذمة عاقديه، وأهمها: الأثر الإيجابي، والأثر السلبي.
وقد تناولنا في الكتاب مفهوم الأثر السلبي للإتفاق على التحكيم - الوسيلة الفنية إعماله "الدفع بالتحكيم" - والخلاف بصدد تحديد طبيعتها القانونية في الفقه - وأحكام القضاء - طبيعة الدفع بالتحكيم من وجهة نظر الباحث - نطاق الأثر السلبي للإتفاق على التحكيم - وتفسير القضاء له، وذلك على أربعة أبواب كالتالي:-
الباب الأول: التحكيم الاختياري هو الصورة العامة لنظام التحكيم، الباب الثاني: مفهوم الأثر السلبي للاتفاق على التحكيم "الوسيلة الفنية لأعماله الدفع بالتحكيم والخلاف الفقهي بصدد طبيعتها القانونية"، الباب الثالث: نطاق الأثر السلبي للاتفاق على التحكيم، الباب الرابع: تفسير القضاء العام في الدولة للأثر السلبي للاتفاق على التحكيم.
