إن مجال هذه الدراسة المقارنة لأركان الإتفاق على التحكيم، وشروط صحته سوف يقتصر على اتفاقات التحكيم الوطنية البحتة والخاضعة للسيادة التشريعية للقانون الوطني "المصري، أو الفرنسي المقارن". بمعنى، العلاقات الداخلية التي اتفق على إخضاعها لقواعد التحكيم داخل الدولة، بالتطبيق لقواعد الإجراءات الوطنية، أي العلاقات الوطنية البحتة بمختلف عناصرها، ولقد سلكنا في هذه الدراسة مسلكًا يتفق وتحقيق الغاية المرجوة منها، فقد قسمتها إلى ستة أبواب: (الباب الأول: التحكيم الإختياري هو الصورة العامة لنظام التحكيم، الباب الثاني: مفهوم الأثر السلبي للاتفاق على التحكيم- شرطًا كان، أم مشارطة، الباب الثالث: الوسيلة الفنية لإعمال الأثر السلبي للاتفاق على التحكيم "الدفع بالتحكيم"، والخلاف الفقهي بصدد تحديد طبيعتها القانونية، الباب الرابع: نطاق الأثر السلبي للاتفاق على التحكيم، الباب الخامس: مدى اختصاص القضاء المستعجل بالوجه المستعجل من النزاع موضوع الاتفاق على التحكيم- شرطًا كان، أم مشارطة، الباب السادس، والأخير: تفسير القضاء العام في الدولة للأثرالسلبي للاتفاق على التحكيم- شرطًا كان، أم مشارطة، وإلى تفصيل كل هذه المسائل).
