يثير اتفاق التحكيم، كثيرًا من الخلاف، سواء من حيث مفهومه أو أركانه أو شروطه أو نطاقه؛ إذ تتباين الاختلافات بسبب الطبيعة الخاصة لاتفاق التحكيم؛ وعليه، فإن دراسة اتفاق التحكيم تقتضي بيان مفهوم اتفاق التحكيم، من حيث تحديد المقصود به، آثاره وصوره وسماته، كما أن الأمر يتعلق بتحديد أركانه وشروطه، فضلًا عن تحديد نطاقه المفترض، سواء من حيث الأشخاص أو من حيث الموضوع، ودراسة اتفاق التحكيم تثير العديد من التساؤلات، يتعلق بعضها بتحديد المقصود باتفاق التحكيم وطبيعته القانونية وصوره وخصائصه وأركان وشروط ونطاق اتفاق التحكيم، ومدى امتداد هذا الشرط لغير أطرافه، وتأتي أهمية دراسة اتفاق التحكيم من حيث مفهومه وأركانه ونطاقه في القانون المصري وقوانين وأنظمة التحكيم المقارنة في الوقت الحاضر على إثر التعديلات التي طرأت عام 2006 على قواعد القانون النموذجي للتحكيم التجاري الدولي (الأونسيترال) الصادرة عام 1985، وإعادة صياغة قواعد التحكيم التجاري الدولي (الأونسيترال) الصادرة في عام 1976، وفي عام 2010، وفي عام 2012، الأمر الذي يعكس اهتمام المجتمع الدولي بموضوعه، وعلى هذا تنقسم دراسة موضوع اتفاق التحكيم إلى ثلاثة مباحث، نتناول في المبحث الأول مفهوم اتفاق التحكيم، وفي المبحث الثاني أركان اتفاق التحكيم وشروطه، وفي المبحث الثالث نطاق اتفاق التحكيم.
