لا ريب فى أن التعامل عبر شبكة الإنترنت أصبح الآن حقيقة واقعة, وأن مستخدميها فى إزدياد مستمر. ويرجع ذلك إلى ما يحققه هذا النوع من التعامل من مزايا كثيرة تساعد على توفير الوقت والجهد والنفقات.لكن هذا "الانتشار" لن يؤتى أكله إلا إذا استطعنا تحقيق أمن هذه الشبكات, ولن هذا الأمن إلا من خلال تحديد إطار قانونى واضح ومحدد لمثل هذا النوع من التعامل, وحتى لا تصبح هذه الشبكات نهباً للقرصنة وسوء الاستخدام وخرق حرمة المعلومات الشخصية. وتتنوع محاور هذا الإطار القانوني حسب موضوع الحماية. فقد يتعلق بحماية المستهلك الذى يتعاقد بتكوين العقد الإلكترونى وتنفيذه, وقد يتعلق بحماية المستهلك الذى يتعاقد عبر شبكة الإنترنت, وغير ذلك من الموضوعات الهامة.
والواقع أن القواعد العامة للقانون قد لا تستطيع تحقيق الأمن المنشود للتعامل عر الانترنت, أو ما يسمى بالتجارة الإلكترونية, لا سيما فيما يتعلق بإثبات عقود التجارة الإلكترونية وحماية ما يسمى بالمستهلك الإلكترونى, بل وانعقاد العقد الإلكترونى ذاته. لذلك لجأت بعض الدول إلى إصدار قوانين خاصة لتنظيم التجارة ال؟إلكترونية, بينما ارتأى البعض الآخر التريث بعض الوقت وترك الأمر لحكم القواعد العامة. وسواء تم تنظيم التجارة الإلكترونية بقواعد خاصة أم ترك أمرها لخكم القواعد العامة, فإن تحديد حجمية ما يسمى بالدليل الإلكتروني, ووضع الإطار العام لحماية المستهلك الإلكتروني, وإبراز خصوصية ما يسمى بالعقد الإلكترونى يلعب دور هاملً فى تحقيق أمن التجارة الإلكترونية من الناحية المدنية. وتحقياً لذلك نتناول فيما يلى- فى مبحث تمهيدي- مفهوم التجارة الإلكترونى ومقتضياتها, ثم القواعد التى تمثل الحماية الذاتية لإبرام العقد الإلكتروني (الفصل الأول), وحماية المستهلك الإلكتروني (الفصل الثاني), ومدى حجية ما يسمى بالمستند الإلكتروني (الفصل الثالث).
