يحتاج الإنسان - مهما كان العصر الذي يعيش فيه - إلى بعض "الضروريات" التي لا غنى عنها، حتى يستمر في البقاء ويقي نفسه ويلات الجوع والعطش . فهناك من الأشياء ما يعتبر الحد الأدنى اللازم لمعيشة الإنسان لا يمكنه العيش بدونها. وهو عندما يسعى للحصول على هذه "الحاجيات" الضرورية لحياته، فهو - في حقيقة الأمر - يختص بها أي يمتلكها. ومن هنا نشأت فكرة الملكية في أبسط معانيها. فلكي يعيش الإنسان يجب أن يحصل على الأشياء الضرورية للإستهلاك، ولأجل ذلك يجب أن يكون مالكاً مسبقاً". فالملكية إذن وسيلة لاستمرار الحياة، وباعث على الوجود وبقاء الحياة على الأرض. وكما لا توجد ملكية بدون حياة، إذ تفقد - حينئذ - مبرر وجودها، فلا توجد حياة بدون ملكية. وقد عبر "ديكارت" عن ذلك بقوله "أنا موجود إذن أنا مالك، Je suis, donc je suis proprietaire .
وقد حظيت الملكية الخاصة - منذ نشأة ها - باهتمام المفكرين في العالم. فتناولها العلماء والفلاسفة والإقتصاديون بالمناقشة والتحليل من حيث نشأتها وأساسها ومشروعيتها وتطورها، فاتفقوا قليلاً واختلفوا كثيراً.
ولا ريب في أن نظام الملكية بوجه عام ذو اثر بالغ في حياة الأمم الإجتماعية والإقتصادية والسياسية، ومن ثم كان سريع التغيّر والتطور بمرور الزمن وتطور المجتمعات وتغير أساليبها السياسية ونظمها الإجتماعية. لذلك لم يبقَ حق الملكية كما نشأ، بل تطور تطوراً هائلاً على مر العصور من حيث نطاقه ومضمونه ووظيفته بل وأساسه. فهو - تارةً - حق فردي مطلق يستطيع صاحبه أن يتصرف فيه كما يشاء وأنى شاء، وهو - تارة أخرى - وظيفة إجتماعية يقوم بها المالك لتحقيق المصلحة الإجتماعية، وتوسط البعض فجعل من الملكية حقاً له وظيفة إجتماعية.
ونتناول في هذه الدراسة حق الملكية بوجه عام (القسم الأول) ثم الحقوق المتفرعة عن الملكية (القسم الثاني).
