إن التفكير في إبرام العقد إلكترونياً لم يكن موجوداً في ذهن أجدادنا، أما الآن فلم يعُد مجرد فكرة، بل أصبح حقيقة.
لقد أصبح اليوم إقتناء السلع والخدمات عبر التجارة الإلكترونية شيئاً عادياً، وبمجرد الضغط على بعض المفاتيح، تسير الأمور على أحسن ما يرام وبسرعة تفوق الخيال، ليتضحَ فيما بعد أن المنتوج ليس كما طلِبَ وأن الفاتورة أكثرٍ من المتوقع، وأنّ الشروط تعسفية مجحفة حتى يصل بك الحال مقيداً بعقدٍ لم تكن على علم بكل جزئياته.
لقد حاولنا في هذا البحث أن نختار موضوعاً أكثر حيوية وواقعية، إذ أصبح موضوع حماية المستهلك في مقدمة الواجبات الأساسية للدولة المعاصرة، إذ ان هذا الموضوع قد أخذ ولا يزال يأخذ بعداً عالمياً، سيما وأن أغلب فئات المجتمع من المستهلكين.
إن هدف الدراسة الأساسي هو إيجاد الآليات القانونية الكفيلة بحل المشكلات التي تواجه المستهلك في عقود التجارة الإلكترونية، سواء في مرحلة ما قبل التعاقد الإلكتروني، أو في مرحلة إبرام العقد الإلكتروني، وسنحاول الإستفادة من بعض التشريعات الأوروبية، كفرنسا، وبعض البلدان العربية، كلبنان، ومصر، التي خطت خطوات ثابتة ومحمودة في ترسيخ مفهوم حماية المستهلك وزيادة ثقة هذا الأخير للمضي قدماً في التعامل عبر التجارة الإلكترونية.
